New York law adds recording safeguard to medical aid in dying, sparking ethical debate

New York has enacted a law that permits terminally ill residents with six months or less to obtain medication for self-directed death. A distinctive feature of the legislation is that patients must record their oral request on audio or video before receiving the drug.

The recording requirement is meant to provide clear evidence that the decision is truly the patient’s and to guard against undue influence.

Supporters of medical aid in dying say that offering the option respects autonomy and gives patients control over the end of their lives.

Philosopher David Velleman, however, warns that simply having the choice can be harmful. He argues that the existence of an option may create pressure or distress even when no external coercion is present.

The new safeguard highlights the ethical complexity of assisted-suicide policies, suggesting that more choice does not automatically translate into greater well-being.
