Capricor sues Nippon Shinyaku over delayed Duchenne drug rollout and pricing formula flaw
Capricor Therapeutics has filed a lawsuit in New Jersey alleging that Nippon Shinyaku and its US subsidiary NS Pharma have failed to execute agreed upon marketing plans for the company's Duchenne muscular dystrophy therapy.
The complaint also says a pricing formula in the exclusive distribution agreement contains a fatal flaw that would make the drug economically impracticable for patients covered by Medicare, Medicaid and private insurers.
Nippon Shinyaku disclosed the pricing problem in March 2025, but Capricor says the issue remains unresolved and could prevent desperate patients from accessing the treatment if it receives approval.
