Biotech firms rally to defend FDA's mifepristone approval in Louisiana lawsuit
Biotech companies, executives and investors filed an amicus brief supporting the FDA in the Louisiana case that seeks to limit access to the abortion pill mifepristone.
The brief is signed by 61 entities, including Arsenal Biosciences, C4 Therapeutics, Nkarta, ReCode Therapeutics, Trace Neuroscience, as well as investment firms such as RA Capital Management and Samsara Biocapital.
The filing argues that FDA-approved drugs should not be subject to judicial recall and that overturning the agency's scientific judgment would damage the pharmaceutical and biotech industry.
Louisiana's lawsuit, filed in October 2025, challenges the FDA's 2023 decision allowing mifepristone to be mailed to patients, a rule the state says facilitates abortions.
